1. Agreement to Terms
By creating an account or using Mark-O-Matic ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
Mark-O-Matic is operated by Weevil Labs ("we," "us," "our"). The Service is hosted at www.markomatic.app.
2. What Mark-O-Matic Does
Mark-O-Matic is an AI-powered essay grading tool for university teachers. You upload student papers and a rubric. The Service uses AI (Anthropic's Claude) to evaluate each paper against your rubric, generating scores, inline comments, and written feedback. You can then export the results in multiple formats (PDF, DOCX, CSV, XLSX, Markdown).
Mark-O-Matic is a grading assistant, not a replacement for professional judgment. AI-generated evaluations are suggestions. You are responsible for reviewing, adjusting, and finalizing all grades and feedback before sharing them with students or submitting them to your institution.
3. Eligibility
To use Mark-O-Matic, you must:
- Be at least 18 years old.
- Be a university teacher, instructor, teaching assistant, or educational professional (or acting in a similar capacity).
- Have the authority to upload any student work you submit to the Service.
- Provide a valid email address for account creation.
Mark-O-Matic is not intended for use by students directly. Students do not create accounts or interact with the Service.
4. Your Account
4.1 Account Creation
You create an account using an email address and password. You are responsible for keeping your login credentials secure. Do not share your account with others.
4.2 Account Responsibility
You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@weevillabs.dev.
4.3 Account Termination
You may stop using the Service at any time. To delete your account and all associated data, contact us at support@weevillabs.dev and we will process the deletion within 30 days.
We may suspend or terminate your account if you violate these Terms, use the Service for purposes it was not designed for, or engage in activity that harms the Service or other users.
5. Acceptable Use
You agree to use Mark-O-Matic only for its intended purpose: grading and providing feedback on student academic work. You agree not to:
- Upload content that is illegal, harmful, or violates the rights of others.
- Upload content unrelated to academic grading (the Service is not a general-purpose AI tool).
- Attempt to reverse-engineer, decompile, or extract the source code of the Service.
- Attempt to circumvent security measures, rate limits, or access controls.
- Use automated tools (bots, scrapers) to access the Service, except through our documented API if one is provided.
- Resell, sublicense, or redistribute the Service without written permission.
- Misrepresent AI-generated evaluations as entirely human-written assessments if your institution prohibits such use.
6. Student Data and Your Responsibilities
6.1 You Control the Data
When you upload student papers, you are the data controller. You decide what to upload, when to grade it, and when to delete it. We process the data on your behalf to provide the grading service.
6.2 Your Obligations
By uploading student work, you represent that:
- You have the authority to submit the work for AI-assisted grading (through your role as the course instructor, teaching assistant, or equivalent).
- Your use of the Service complies with your institution's policies on AI tools, data handling, and student privacy.
- You will inform students if required by your institution's policies that their work may be processed by an AI grading tool.
6.3 FERPA Note
Individual teacher accounts on Mark-O-Matic are not FERPA-covered entities. If your institution requires a data processing agreement (DPA) for FERPA compliance or similar regulatory requirements, contact us at support@weevillabs.dev before uploading student data. 7. Intellectual Property
7.1 Your Content
You retain full ownership of everything you upload to Mark-O-Matic: student papers, rubrics, assignment configurations, and any other content you provide. We do not claim any ownership or license over your content beyond what is necessary to provide the Service.
The limited license you grant us: By uploading content, you grant Weevil Labs a non-exclusive, temporary license to process that content through our AI grading pipeline (including sending extracted text to Anthropic's API). This license exists solely to provide the Service and terminates when you delete the content.
7.2 AI-Generated Output
Evaluation results (scores, comments, feedback, summaries) are generated by AI based on your rubric and your students' papers. You may use, edit, distribute, and incorporate these outputs however you choose. We do not claim ownership of AI-generated evaluation output.
7.3 Our Intellectual Property
The Service itself (code, design, branding, documentation) is owned by Weevil Labs. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service as intended.
8. AI Limitations and Disclaimer
Mark-O-Matic uses Anthropic's Claude to evaluate student work. You should understand the following:
- AI is not perfect. Evaluations may contain errors, inconsistencies, or misjudgments. Always review AI-generated grades and comments before finalizing them.
- AI detection is advisory only. The Service includes an AI-detection score for each paper. This score is one data point, not a verdict. Do not use it as the sole basis for academic integrity decisions.
- Rubric quality matters. The quality of AI evaluations depends heavily on the rubric you provide. Vague or ambiguous rubrics will produce vague or inconsistent results.
- Grading philosophy. The AI is configured to grade generously and constructively, with awareness that many users teach EFL (English as a Foreign Language) students. If this approach does not match your grading standards, adjust scores accordingly.
9. Service Availability
We aim to keep Mark-O-Matic available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance or updates.
- Infrastructure issues with our hosting providers (Vercel, Supabase).
- API rate limits or outages at Anthropic.
- Circumstances beyond our reasonable control.
We will make reasonable efforts to notify users of planned downtime. We are not liable for losses caused by service interruptions.
10. Pricing, Payment, and Refunds
10.1 Payment Processing
All payments for Mark-O-Matic are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. Paddle handles payment processing, invoicing, sales tax, and VAT on our behalf. When you make a purchase, your transaction is governed by Paddle's Checkout Buyer Terms in addition to these Terms. We do not directly collect, store, or process payment card information.
10.2 Credit Bundles
Mark-O-Matic uses a credit-based pricing model. You purchase a bundle of grading credits at a fixed price. Each grading operation consumes credits based on the length and complexity of the submitted paper and your configured grading settings. Bundle sizes, pricing, and credit consumption rates are published on our billing page and may be updated from time to time. Unused credits in an active bundle do not expire.
10.3 Free Trial
New accounts receive a limited free trial that allows you to grade a small number of submissions at no cost. The free trial is provided so you can evaluate the Service before purchasing. Free trial credits carry no cash value and are not refundable.
10.4 Refund Policy
We offer a 30-day money-back guarantee on all credit bundle purchases. If you are unsatisfied with the Service for any reason, you may request a full refund within 30 days of your purchase date, regardless of how many credits you have used.
To request a refund, email support@weevillabs.dev with the email address associated with your account and your reason for the request. We will process approved refunds through Paddle within 5 business days of approval. Refunds are returned to the original payment method. Card refunds typically take 3 to 5 business days to appear on your statement. PayPal refunds typically appear within 48 hours.
After the 30-day window, refunds are granted only in the following circumstances:
- Service failure. The Service was materially unavailable or non-functional for an extended period, preventing you from using credits you purchased.
- Duplicate charge. You were charged more than once for the same bundle due to a processing error.
- Legal entitlement. Applicable consumer protection law in your jurisdiction provides a statutory right to a refund.
Refund requests submitted more than 120 days after the original transaction cannot be processed due to payment processor limitations.
When a full refund is issued, the associated credit bundle is deactivated and any remaining credits are removed from your account. Partial refunds may be issued at our discretion for unused credits on a pro-rata basis.
10.5 Price Changes
We may adjust pricing for credit bundles at any time. Price changes do not affect bundles you have already purchased. We will notify existing users at least 14 days before any price increase takes effect.
10.6 Chargebacks
If you have a concern about a charge, please contact us at support@weevillabs.dev before initiating a chargeback with your bank or payment provider. We are committed to resolving billing disputes promptly. Filing a chargeback without first contacting us may result in account suspension pending resolution.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Weevil Labs provides Mark-O-Matic "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not warrant that AI-generated evaluations are accurate, complete, or suitable for any particular purpose.
- We are not liable for any grades, feedback, or academic decisions made based on the Service's output.
- Our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim (or zero, if you are using the free tier).
- We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, loss of academic standing, or reputational harm.
12. Indemnification
You agree to indemnify and hold harmless Weevil Labs from any claims, damages, or expenses (including reasonable attorney fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights, including student privacy rights.
- Any dispute between you and your institution regarding your use of AI grading tools.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by applicable law.
13.2 Informal Resolution First
Before filing any formal legal action, you agree to contact us at support@weevillabs.dev and attempt to resolve the dispute informally. We will make a good-faith effort to resolve your concern within 30 days.
13.3 Jurisdiction
If informal resolution fails, any legal proceedings will be brought in a mutually agreed jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. When we do:
- We will update the "Last Updated" date at the top of this page.
- For material changes (pricing, liability, data handling), we will notify you by email or by a prominent notice in the application at least 14 days before the changes take effect.
- If you continue using the Service after changes take effect, you accept the updated Terms. If you disagree with the changes, stop using the Service and request account deletion.
15. Miscellaneous
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Weevil Labs regarding the Service.
- No Waiver: Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
- Assignment: We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms.
